Terms & Conditions for Inbound Tour

Every communication regarding Tour/Travel Services and reservations should be directed to M/s. India Magical Trip.

Reservation Process:


Upon your booking confirmation, you enter into a contract with M/s. India Magical Trip. A binding agreement between us is established when we authenticate your tour/travel services and acknowledge the receipt of your deposit payment.

Payment:


For availing of the contracted services, you must make an initial deposit of 25% of the total cost to M/s. India Magical Trip. This deposit is necessary to secure your booking on a confirmed basis.

Balance Amount:


The remaining balance should be cleared 15 days before the commencement of services. Any reservation made within 15 business days from the date of services is deemed a late booking, for which the entire payment must be made during the booking itself.

Important Information:


o Excluding the above, reservations for special train journeys, hotel or resort bookings during peak periods (X-Mas, New Year, Pushkar Fair, Diwali etc) necessitate the full payment to be made at the time of booking.

Even after paying the 25% deposit to verify your bookings, there may be scenarios where you'll need to pay an additional upfront amount before the final payment deadline, based on the contractor/supplier's payment requirements when applicable.

Payment Procedure:


Our international clients can remit payment:-

Through Bank Transfer (Telex Transfer) to our bank account

Special Note:


All payments must be comprehensive and devoid of any withholding tax and deduction.

Bank fees, if any, for remittance (levied by the sending bank or intermediary bank) must be fully borne by the payer.

Critical Advisory:


Be aware that no employee or agent of M/s. India Magical Trip (IMT) will request your Net Banking credentials, Password, OTP etc. Nor will they instruct you to transfer funds into a personal account or install third-party apps such as Any Desk, TeamViewer etc.

Don't comply with such requests. Please alert us to such incidents by emailing info@indiamagicaltrip.com.

Terms for Cancellation, No Show, and Early Departure:


Written notice is necessary if a cancellation occurs due to any foreseeable or unforeseeable reasons. The date of reception of this written notice determines the effective date of cancellation, and the following charges will apply:

A 10% charge of the total tour/service cost for cancellations made 60 days or more before arrival.

A 20% charge of the total tour/service cost for cancellations made 59 to 30 days before arrival.

A 25% charge of the total tour/service cost for cancellations made 29 to 15 days before arrival.

A 50% charge of the total tour/service cost for cancellations made 14 to 08 days before arrival.

No refund will be provided for cancellations made 07 days or less prior to arrival, or in the case of a no-show.

Please Note:


1. Regardless of the cancellation categories, if you (the client) cancel the tour/travel services for any reason after booking with us, a minimum 10% service charge will be applied to the total tour package cost.

2. This applies to cancellations made by the client for any reason and also to cancellations made by us for any reason. If we cancel, you have two options:

      o You can be provided with a Credit Note for the booking amount paid, which can be utilized at any future date by you, your family members, friends, or anyone else referred by you.

     o If you prefer a refund, a minimum 10% service charge will be deducted from the total cost of the tour package and the remaining amount will be refunded.

     o The relevant cancellation charges for flight tickets, hotel bookings, travel services, and Guide services will also be recovered from the client in both scenarios.

3. Suppose a trip is cancelled after it has begun. In that case, refunds will be limited and depend on the amount we can recover from hoteliers, airlines, transporters, and other suppliers we work with. We hold no refund responsibilities for unused hotel accommodations, flight tickets, transportation, missed meals, and any other services.

4. Please note that separate cancellation policies apply to special train journeys (such as Palace on Wheels, Deccan Odyssey, Golden Chariot & Maharajas Express) and will be advised when necessary.

5. If a booking made for the following periods is canceled, no refund will be given:

    o During festive periods like Diwali, Dussehra, Holi, Pushkar fair, etc.

    o During the high peak season (20th Dec to 15th Jan).

    o During long weekends.

6. The calculation of the cancellation fee is based on the total booking amount, not just the initial deposit made.

Refund Policy:


Refunds for unused/unutilized services that are cancelled in advance will be processed based on the cancellation policy. Refunds will be issued to the individual who made the payment to us. Please note that the refund procedure might take between 2 to 4 weeks, largely due to banking processes. If the refund is transferred to a credit card or bank account, any charges levied by the bank will be deducted from the refundable amount.

Required Identification Document:


All guests (including Foreign Nationals, NRI’s, and Indian Nationals) are required to provide a Photo ID at the time of booking confirmation. The necessary documents for different categories are:

Foreign nationals – a copy of the passport + Visa.

Non-Resident Indian clients (NRI clients) – a passport copy.

Overseas Indian clients holding OCI/PIO cards – a copy of the passport and OCI/PIO card.

Domestic clients – a Driving License/Voter ID Card/passport copy.

Arrival and Departure Policy:


Check-In Time: 1200 - 1500 Hours.

Early arrival is subject to availability. For guaranteed early check-in, booking from the previous night is required.

Check-Out Time: 1000 - 1200 Hours.

Late check-outs are subject to availability and payment.

Additional Usage of Vehicle:


Please note that extra vehicle usage (cars/coaches with the driver) beyond transfers or sightseeing is not included in the services and is, therefore not allowed.

Special Note for Helicopter Journeys:


1. Helicopter Tickets & Fare availability can change at any moment.

2. Unavailability of helicopter services can happen due to sudden weather conditions, VIP movement, or unavoidable circumstances. We will make every effort to arrange for an alternate helicopter journey on the same day or on different dates, based on helicopter availability.

3. No ticket will be carried forward to the next day

4. No compensation will be provided for accommodation, meals, or transportation costs due to the cancellation of a helicopter journey.

Our Liabilities & Limitations:


Please Note that if the Government of India increases any entrance fees of monuments/museums, taxes, fuel costs, or guide charges after the tour/service cost has been finalized, these additional costs will be charged.

M/s. India Magical Trip negotiates rates with hotels, airlines, and other service providers. If these entities change their rates without notice, we may adjust our quoted rates accordingly.

M/s. India Magical Trip and its associates operate as agents for hotels, airlines, transporters, railways, and other contractors. All exchange orders, receipts, contracts, and tickets we issue are subject to the terms & conditions under which they provide these services.

M/s. India Magical Trip itineraries are just sample itineraries intended to provide a general overview of the expected trip schedule. Factors such as weather, road conditions and the physical ability of participants, etc., may necessitate changes to the itinerary either before the tour or while it's ongoing. We reserve the right to modify any aspect of the itinerary, including transportation and accommodation, in the interest of participant safety, comfort, and general well-being, without any compensation, allowance, or refund. Any additional costs would be the client's responsibility.

M/s. India Magical Trip is not responsible for any delay, change in program, or additional expenses incurred due to unforeseen circumstances or special/consequential loss, injury, and damage resulting from natural hazards, flight cancellations, accidents, breakdowns of machinery or equipment, landslides, political closures, acts of God, floods, fire, governmental actions, wars, civil disturbances, medical or custom department regulations, theft, epidemics, quarantines or any other causes beyond our control. The client shall be responsible for any liability or extra expenses incurred due to these causes.

M/s. India Magical Trip does not accept any liability for any loss of property or damages, including loss of services, which the client may sustain due to negligence or default by any transportation company, hotel agents, or any other service provider. The client using sporting equipment, scuba diving gear, bicycles, sailing boats, hired or supplied by hotels or rental bodies does so at their own risk.

M/s. India Magical Trip doesn't offer any insurance policy that covers expenses related to accidents, illnesses, theft losses, or other eventualities. We advise clients to secure such insurance policies in their home country. Clients bear the risk of all baggage and personal property at all times.

M/s. India Magical Trip reserves the right to cancel any services if we deem the tour, trip, or passage impractical for any reason upon refunding the value thereof. The client will not have any other claim against the company. We also reserve the right to refuse to carry out our contract with any person whom we may consider undesirable at our absolute discretion.

Force Majeure:


M/s. India Magical Trip Including its parent companies, affiliates, subsidiaries, directors, employees, officers, agents, suppliers, successors, heirs, and permitted assigns, will not be held accountable or considered at fault for any inability or delay in fulfilling any obligations, in whole or in part, if such execution is made impractical by events such as war, sabotage, embargo, acts of terrorism, riot or civil unrest, transportation failure, acts by any government or court or administrative agency, acts of God, fire, explosion, flood, earthquake, strike, government actions, or other catastrophes, pandemics, epidemics, disease outbreak or quarantine restrictions, or any other causes beyond the reasonable control of M/s. India Magical Trip. This is referred to as "Force Majeure".

In the event of Force Majeure, both M/s. India Magical Trip. (company) and the client (you) will strive to avoid, counteract, and offset the impacts of any cause or potential cause of such an event. Once the cause of the Force Majeure ends, these Terms and Conditions will fully resume.

Nonetheless, a Force Majeure event does not absolve M/s. India Magical Trip (company) or the client (you) from fulfilling obligations that arose before the Force Majeure event occurred.

Jurisdiction Clause:


All disputes arising out of this agreement or any subsequent agreement will be subject to the jurisdiction of Delhi Courts only.

Special Note:

The Terms & Conditions for Andaman & Nicobar Island, Lakshadweep Island will be separate and will be advised on a case-to-case basis.

The Terms & Conditions for Group bookings will also be separate and will be advised on a case-to-case basis.
